Privacy Consent

By providing your personal information to eCapital Funding Pty Ltd and consenting to the terms below, you authorise us to collect, use and disclose your personal and credit information for the purposes set out in this document and in our Privacy Policy.

1. Purpose of collection

You consent to your personal and credit information being collected, used and disclosed to:

• assess your application (or a related party's application) for a consumer or commercial credit product;
• arrange, manage and administer any credit product provided to you;
• allow us to provide ongoing credit assistance including reviews and refinances;
• comply with legal and regulatory obligations, including anti-money laundering and counter-terrorism financing laws;
• manage complaints and disputes; and
• where you consent, send you information about other products and services.

2. Disclosure to lenders and third parties

You consent to us disclosing your personal and credit information to:

• prospective lenders, credit providers, mortgage managers and mortgage insurers;
• our mortgage aggregation and lender-panel service providers;
• valuers, real estate agents, accountants, solicitors and financial advisers involved in your transaction;
• identity verification, credit assessment and fraud prevention providers;
• our contractors, agents and service providers (including CRM, IT and secure statement providers such as Illion BankStatements and equivalent services);
• any person you have authorised to act on your behalf; and
• government or regulatory bodies where required or authorised by law.

3. Credit reporting

You consent to us:

• obtaining a credit report about you from one or more Australian credit reporting bodies (CRBs) including Equifax, Experian and illion, for the purpose of assessing your application and any future finance applications;
• disclosing your credit information to prospective lenders for the purpose of assessing your application;
• using the information obtained from CRBs and lenders as part of our preliminary assessment as to whether a credit contract is not unsuitable for you.

You acknowledge that if you believe you are, or are likely to be, a victim of fraud (including identity fraud), you can request a CRB not to use or disclose your credit information (a "ban period").

4. Sharing credit information under Comprehensive Credit Reporting

You consent to lenders exchanging your credit information (including repayment history information and financial hardship information) with CRBs and other credit providers as permitted under Part IIIA of the Privacy Act.

5. Electronic delivery of documents

You consent to us and any lender we introduce you to giving you documents and notices (including Credit Guides, Credit Proposal Disclosure Documents, preliminary assessments and privacy notifications) in electronic form to the email address or mobile number you provide.

6. Marketing communications

Unless you tell us otherwise, you consent to us contacting you by phone, email or SMS with information about products and services offered by us and our partners. You may withdraw this consent at any time by unsubscribing from emails, replying STOP to an SMS, or contacting us on 02 3819 3888.

7. Third-party information

Where you provide personal information about another person (for example a co-applicant, guarantor, director or referee), you confirm that you have that person's consent to disclose their information to us and to allow us to collect, use and disclose it in accordance with our Privacy Policy.

8. Overseas disclosure

You acknowledge that some service providers we use may be located outside Australia, including in the United States, the European Union and the Philippines, and that your personal information may be disclosed to such providers as described in our Privacy Policy.

9. Withdrawing your consent

You can withdraw any consent given in this document at any time by contacting us. Withdrawing your consent may mean we are unable to continue to provide credit assistance or manage your finance.

10. Acknowledgement

You confirm that you have read and understood this Privacy Consent and our Privacy Policy, and that the information you have given us is true, accurate and complete.
